The KOD Lyons LLP team comprising of Managing Partner John O’Doherty and Associate Andy Walsh conducted a review into a set of circumstances whereby an employee of an organisation was alleged to have committed an offence of false imprisonment in the course of their duties.

The review examined the relevant statutory powers and functions underpinning the employee’s powers and offered an analysis in respect of the nature and strength of the evidence against them. The training procedures were closely examined and recommendations made to ensure compliance with the scope of the legislative powers.

The review also offered an assessment in respect of the potential liability arising for both the employee and organisation.

Organisations are reminded about the importance of ensuring that their policies and procedures are strictly in adherence with any relevant statutory powers.
