Injuries suffered: Crush injuries to index, middle and ring fingers of right hand

Circumstances of incident: Our client, a general operative in a factory, was cleaning an Unguarded plastic injection moulding machine on the 27th September 2013 when suddenly an airgun became snagged causing his right hand to become crushed in the machine.
The gentleman was unable to return to work due to his age and also could not play the guitar anymore as a result of the injury.

Case history: The employer declined to have the matter assessed with the Personal Injuries Assessment Board. High Court proceedings issued on the 10th March 2016.
The factory employer contested liability throughout the course of the proceedings.
Engineering reports were required to prove the employer’s negligence.
The matter was listed for hearing on the 19th February 2019 and settled once a Judge was assigned to the case.

Settlement Amount: €57,500.00
